PARTICIPATION AGREEMENT, LIABILITY WAIVER & TERMS OF USE

By booking, purchasing, accessing, or participating in any Barre or 10oheight class, whether in-person, live online, recorded, workshop, popup, or program, I acknowledge and agree as follows:

I understand that participation in physical exercise involves inherent risks, including but not limited to muscle strain, injury, illness, permanent disability, or death. I confirm that I am physically fit to participate and assume full responsibility for my health and well-being. I voluntarily assume all risks associated with participation, whether supervised in-person or unsupervised online. I agree to follow all instructions, modify when necessary, and immediately stop if I experience pain or discomfort. I understand that failure to follow instructions is solely my responsibility.

To the fullest extent permitted by law, I release and hold harmless the instructor, assistants, venues, contractors, and affiliated parties from any and all claims, liabilities, demands, damages, or causes of action arising from participation, including claims based on negligence, except where prohibited by law.

I acknowledge that all class content, choreography, programming, materials, recordings, branding, logos, and intellectual property are proprietary and confidential. I agree that I will not record, reproduce, distribute, stream, transmit, publish, teach, copy, or share any class content in any format. I will not share access links, passwords, login credentials, or purchased materials with any third party. All purchases are personal, non-transferable, and non-shareable.

In the event of unauthorized recording, reproduction, distribution, or sharing of any content, I agree that such action constitutes a material breach of this agreement. I agree to pay liquidated damages in the amount of [5,000 KWD] per violation, in addition to any actual damages, injunctive relief, and recovery of legal fees and enforcement costs. I acknowledge that this amount represents a reasonable estimate of damages resulting from unauthorized distribution.

All purchases are final. Packages and memberships are non-refundable, non-transferable, and must be used within their stated validity period. Expired sessions are forfeited. Missed classes, late cancellations, no-shows, or change of mind do not qualify for refunds. The instructor reserves the right to modify schedules, pricing, formats, policies, or refuse participation at their discretion.
